  • Paul Duggan came to the Bar in May 1996. While he has a mainly commercial practice he also appears in administrative, criminal and professional disciplinary jurisdictions. He is frequently briefed in VCAT (especially in the Domestic Building List) but has experience in all Victorian courts including the Court of Appeal.

    Civil matters in which Paul has appeared as sole counsel include:

  • Fabian Amber Pty Ltd v Liano [2003] VCAT 2005 (a VCAT decision concerning the tenant's entitlement to the refund of rent paid in the absence of the disclosure statement required under the Retail Tenancies Reform Act);

  • Loftus v Clark [2003] FMCA 66; (2003) 174 FLR 240 (a Federal Magistrates' Court decision concerning the circumstances in which leave to proceed against a bankrupt in extant litigation should be granted pursuant to the Bankruptcy Act);

  • Loh v Shi [2003] VSC 271 (a Victorian Supreme Court case concerning the jurisdiction of VCAT to make eviction orders under the Residential Tenancies Act) and

  • P. Aker Flowerbulbs Pty Ltd v Coulter [2004] FCA 1486 (a decision of the Federal Court dealing with the interpretation of the word "stay" for the purposes of the Bankruptcy Act).


  • Outside the commercial sphere Paul's experience as a barrister includes:
  • both pleas and summary contests in criminal matters ranging from petty crime and driving matters through to OHSA, EPA and Copyright Act prosecutions;

  • appearances involving statutory disciplinary tribunals and inquiries directed against professionals such as tax agents, teachers, accountants and others

  • appeals against sentence in the County Court; and

  • state and Commonwealth administrative appeals


  • Paul was accredited by the Victorian Bar as a mediator in 2005.

    Before coming to the Bar Paul had two careers -
  • a total of 4 years as a solicitor at Dunhill Madden Butler and then Arthur Robinson & Hedderwicks where his areas of special interest were insurance and environmental law; and

  • 6 years as a journalist with publications including 'The Herald' and 'The Age'


  • Paul's interests outside the law include skiing, farming and learning German from his 5 year old daughter and her three younger brothers.
