  • Overview: John Lewisohn practises mainly in the general area of commercial law and also in associated legal fields. He has a broad based practice. His work therefore extends to a number of other areas of legal interest. It includes alternative dispute resolution processes.

    General Commercial Law: John has considerable experience in a wide range of commercial matters and has been involved in a number of very substantial cases. Broadly this area of his legal practice covers subjects like partnership, trusts, corporations and banking, fiduciary relationships, equitable obligations and remedies [including injunctions and receivers], unjust enrichment, trade practices, insurance, international trade, carriage of goods, shipping, guarantees and securities, property law [including sales, leases and mortgages], passing off, confidential information and intellectual property.

    Other Areas of Law: John also does work in areas such as administrative law, land acquisition, local government, town planning, construction disputes, professional negligence and most other aspects of common law.

    Mediation: John is an experienced mediator and is accredited with the Victorian Bar and with The Institute of Arbitrators and Mediators Australia. He has participated in the successful resolution of many mediations, particularly in a commercial litigation context. He has been a member of the Victorian Bar Dispute Resolution Committee since 1993.

    Arbitration: John is registered as a Grade 2 Arbitrator on the panel of The Institute of Arbitrators and Mediators Australia.

    Fees: Where appropriate, fees are related to the nature of the case, the jurisdiction and client's means. They are generally based on hourly or daily rates and negotiable.

    Background Notes: John has experience in the High and Federal Courts as well as the Supreme, County [and Magistrates] Courts. Lecturer in Legal Persons [the subjects of company law, partnership and trade unions] for the Supreme Court of Victoria/Council of Legal Education/RMIT Course for Articled Clerks for ten years. Educated at Melbourne University [Trinity College] and Geelong Grammar School. Established original voluntary South Melbourne Legal Service. Former member, Law Committee, Royal Melbourne Hospital, Parkville. Associate of the Institute of Arbitrators and Mediators Australia. Member, Australian Institute of International Affairs.
