Anton Trichardt has had almost 20 years experience in the legal profession. He holds degrees in Law and in Law & Management from universities in South Africa, the United States of America and Australia. While studying towards a Masters degree on a Fulbright Scholarship in the United States, where Anton was granted the H Edsall Olson Scholarship as well as the American Jurisprudence Awards for Comparative Law and International Business Law, he worked part-time at Baker & MacKenzie, Chicago. On his return to South Africa he did articles of clerkship at Edward Nathan and Friedland Inc before joining the Johannesburg Bar, where he appeared in numerous cases as counsel in South Africa and Namibia, many of which have been reported.
In view of his expertise in respect of the US divestment legislation, Anton was engaged as an expert witness by the MacDonalds Corporation of the USA to testify on the effect of such legislation on its activities in South Africa in a test case relating to expungement of trademark applications. While practising at the Johannesburg Bar, Anton was a lecturer in Transnational Business Law for post-graduate students at the University of Pretoria. Before that he worked as a law advisor at the Department of Justice and was a researcher and contributor to the Report of the Commission of Enquiry into the Structure and Functioning of the Courts in South Africa. Since migrating to Australia in 1996 and before joining the Victorian Bar, Anton was a senior associate at Mallesons Stephen Jaques and Freehills respectively.
Anton has authored and co-authored more than 30 publications in Australia, the United Kingdom, The Netherlands and South Africa. His publications include three monographs, ie 'Disinvestment, Divestment, Divestiture - A Survey of US State, County and Municipal Legislation', 'Extraterritorial Application of United States Antitrust Laws', and 'The Purchase by a Company of its own Shares'. The latter was accepted by the South African Standing Advisory Committee on Company Law as its official working document. Many of the provisions of the draft Companies Amendment Bill contained in this publication were subsequently adopted verbatim in the South African Companies Amendment Act of 1999. More recent publications include topics such as 'Chameleonic Documents in Law - a Comfort Letter Trilogy', 'Market Stabilisation and the Green Shoe Option: Some Comments from Australia', 'The UNCITRAL Model Law on Cross Border Insolvency: Some comments from the Antipodes', 'Plugging Black Holes: Freezing Assets in aid of Foreign Proceedings' and 'War Clauses in Charter - Parties - there is more to War than you think'.
Anton has delivered various papers at a variety of forums on topics ranging from 'The Future Development of South African Corporate Law', Arrest of Vessels, Actions in Rem and Maritime Liens', 'The Liability of Sport Administrators for Sport Injuries', 'Anshun Estoppel', 'Mareva Injunctions' to 'Novel Causes of Action and the Common Law of Obligations'. He also speaks Afrikaans fluently and has a working knowledge of Dutch and Flemish.
