Simon Loftus

Simon's practice is principally in the areas of commercial litigation and insurance.

Since coming to the bar, Simon has advised and appeared in matters involving partnership Law; fiduciary duties; contract; commercial leases including actions for possession and recovery of rent; insolvency, product liability; medical negligence; nuisance; debt recovery, and professional negligence. He has also been instructed in common law and statutory compensation matters. He is familiar with and has provided advice on the Accident Compensation Act 1985, Transport Accident Act 1986 and the Wrongs Act 1958.

Simon's practice includes advice and appearance work in the Supreme Court Commercial Court, County and Magistrate's Courts, and VCAT.

Prior to coming to the bar, Simon was a solicitor in private practice for 16 years practising in the areas of commercial litigation and insurance. He practised as a solicitor with Arnold Bloch Leibler, was a Senior Associate at DLA Phillips Fox, and Special Counsel at Herbert Geer. He was a partner at Ligeti Partners.

Simon's experience in private practice was exclusively in litigation acting for corporations and insurers involving contract and commercial disputes, insolvency, professional indemnity (including medical negligence), construction law and public liability.

Simon also spent three years as Senior Legal Counsel at Symbion Health Limited (subsequently Primary Health Care Limited.) During his time at Symbion Health, Simon was responsible for litigation and advice involving corporations law, contracts, trade practices, intellectual property, insolvency, product recall, privacy, the Health Insurance Act, occupational health and safety, insurance and medical negligence. Simon has a particular interest in health law matters.
